Terms of Service
Last updated: September 26, 2026
These Terms of Service (“Terms”) govern your use of the GrindGALLERY website and any purchase made through our online store.
Throughout these Terms, “GrindGALLERY,” “we,” “us,” and “our” refer to the operator of the GrindGALLERY store.
By accessing our website or placing an order, you agree to these Terms together with our:
-
Privacy Policy.
-
Refund & Returns Policy.
-
Shipping Policy.
-
Legal Notice.
Nothing in these Terms limits any mandatory rights available to consumers under applicable law.
1. Use of the Website
You may use this website only for lawful purposes and in accordance with these Terms.
You must not:
-
Use the website for fraudulent or unlawful purposes.
-
Attempt to interfere with the operation or security of the website.
-
Introduce malicious software or harmful code.
-
Attempt to gain unauthorised access to systems, accounts or information.
-
Scrape, reproduce or commercially exploit website content without permission where such activity is prohibited by applicable law.
-
Use the website in a way that infringes the rights of GrindGALLERY or another person.
We may restrict access to the website where reasonably necessary for security, fraud prevention, legal compliance or protection of our legitimate interests.
2. Eligibility to Purchase
We do not impose a specific minimum purchasing age beyond the requirements of applicable law.
By placing an order, you confirm that you have the legal capacity required to enter into the transaction or, where applicable, that the transaction is made with the necessary permission or representation required by law.
3. Products
GrindGALLERY sells decorative artistic products, including shadow boxes, handmade or partially handmade pieces, unique works and limited-edition products.
Product availability may be limited.
Certain products may not be restocked after they are sold.
We make reasonable efforts to display products accurately. However, slight variations may occur due to factors including:
-
Handmade production.
-
Materials.
-
Finishing.
-
Individual craftsmanship.
-
Lighting used in photography.
-
Screen settings or display calibration.
-
Natural variations between individual pieces.
Such minor variations do not necessarily constitute a defect where they are consistent with the nature and description of the product.
Nothing in this section affects rights relating to goods that are materially different from their description or otherwise non-conforming under applicable law.
4. Unique and Limited-Edition Products
Certain GrindGALLERY pieces may be unique, produced in limited quantities or unavailable once existing inventory has been sold.
Adding a product to a cart does not reserve it unless expressly stated otherwise.
Availability is not guaranteed until an order has been accepted.
5. Orders
When you submit an order through checkout, you are making an offer to purchase the products included in that order.
An automated email acknowledging receipt of an order does not necessarily mean that the order has been finally accepted.
The order is accepted when GrindGALLERY confirms acceptance of the order or begins fulfilment or dispatch, whichever occurs first.
We reserve the right, where reasonably justified, to reject or cancel an order before or after payment in circumstances including:
-
Suspected fraud or unauthorised payment activity.
-
An obvious pricing or product-information error.
-
Product unavailability.
-
Duplicate or abnormal orders.
-
Shipping restrictions.
-
Failure to obtain payment authorisation.
-
Legal or regulatory restrictions.
-
A technical error materially affecting the transaction.
-
Other legitimate circumstances that prevent us from fulfilling the order.
If GrindGALLERY cancels an order after payment and no amount is otherwise properly due, amounts collected for the cancelled order will be refunded using the appropriate payment method.
Mandatory consumer rights remain unaffected.
6. Prices
Prices displayed on the website may be changed at any time before an order has been accepted.
A price change will not retrospectively alter the agreed product price of an order that has already been validly accepted, except where applicable law permits correction of an obvious error.
Prices, taxes, duties and shipping costs applicable to your destination will be displayed or calculated during checkout where relevant.
Depending on the destination and applicable tax treatment, displayed prices may include or exclude particular taxes.
The final amount payable will be shown before completion of the order.
7. Obvious Pricing Errors
We make reasonable efforts to ensure that product prices are accurate.
If a product is mistakenly displayed at a price that is clearly and objectively erroneous, we may contact the customer and, where legally permitted, cancel or correct the affected transaction.
We will not rely on this provision to retrospectively change a genuine agreed price merely because we later decide that the product should have been sold for more.
8. Payment
Available payment methods are displayed during checkout.
You confirm that you are authorised to use the payment method selected.
Payment processing may be carried out by third-party payment providers and may be subject to their technical and security procedures.
An order may be rejected or cancelled if payment cannot be successfully authorised or if there are reasonable grounds to suspect fraud or unauthorised use.
9. Shipping and Delivery
Order processing, shipping services, estimated delivery times, tracking and international delivery terms are described in our Shipping Policy, which forms part of these Terms.
Delivery estimates are not guaranteed delivery dates unless expressly agreed otherwise.
Mandatory rights relating to delivery remain unaffected.
10. Returns, Withdrawal and Refunds
Returns, statutory withdrawal rights, refunds, personalised products, damaged products and cancellations are governed by our Refund & Returns Policy, which forms part of these Terms.
Nothing in these Terms excludes mandatory statutory rights relating to withdrawal, conformity, repair, replacement, price reduction or refund.
11. Personalised and Custom Products
Certain products may be produced according to individual customer specifications or clearly personalised.
Where applicable law permits, such products may be excluded from change-of-mind cancellation or withdrawal rights.
Any applicable exclusion will not affect mandatory rights relating to defective, damaged, incorrect or non-conforming goods.
12. Promotional Codes
GrindGALLERY may offer promotional codes, discounts or other promotional offers.
Promotions may be subject to specific terms including:
-
Validity periods.
-
Eligible products.
-
Minimum order amounts.
-
Geographic restrictions.
-
Usage limits.
-
Restrictions on combining promotions.
Unless otherwise stated, promotional codes:
-
Have no cash value.
-
Cannot be exchanged for cash.
-
May not be applied retrospectively to completed purchases.
-
May be withdrawn or modified before use where legally permitted.
We may reject use of a promotional code where there is evidence of fraud, misuse, technical error or violation of the applicable promotional conditions.
13. Gift Cards
GrindGALLERY may offer gift cards or digital store credit.
Gift cards may be subject to additional conditions displayed when purchased or issued.
Any expiration dates or limitations will be applied only where permitted by applicable law.
Gift cards are not redeemable for cash except where required by law.
14. Customer Reviews and Other Content
Customers may be able to submit reviews, comments or other content.
You remain responsible for content you submit.
Content must not:
-
Be unlawful, fraudulent, defamatory, threatening or abusive.
-
Infringe intellectual property or privacy rights.
-
Contain malicious code.
-
Misrepresent an experience with a product.
-
Constitute spam or unauthorised advertising.
We may moderate or remove content where reasonably necessary to enforce these rules, comply with law or protect the website and its users.
By submitting content to the website, you grant GrindGALLERY the permissions reasonably necessary to display, reproduce and use that content in connection with operating and promoting the store, subject to applicable law.
15. Intellectual Property
The GrindGALLERY website and the content made available through it, including where applicable its:
-
Branding.
-
Logos.
-
Product photography.
-
Original designs.
-
Graphics.
-
Text.
-
Layout.
-
Website content.
-
Original artistic materials.
are protected by applicable intellectual property laws to the extent that GrindGALLERY owns or is authorised to use those rights.
Except where permitted by law or expressly authorised in writing, you may not reproduce, copy, distribute, modify, commercially exploit, publish or create derivative commercial material from protected GrindGALLERY content.
Purchasing a physical product does not, by itself, transfer intellectual property rights in any underlying artwork, design, photograph or other protected material.
16. Third-Party Services
Our website may rely on third-party services including Shopify, payment providers, logistics providers and other technology or operational providers.
The availability and operation of certain features may therefore depend partly on third-party systems.
Nothing in these Terms excludes any responsibility that GrindGALLERY is legally required to assume in relation to the services provided to the customer.
17. Website Availability
We aim to maintain the website and online store in working order, but uninterrupted or error-free availability cannot be guaranteed.
We may temporarily restrict or suspend access for:
-
Maintenance.
-
Security.
-
Technical upgrades.
-
System failures.
-
Circumstances outside our reasonable control.
Where reasonably possible, we will seek to minimise disruption.
18. Accuracy of Website Information
We make reasonable efforts to keep product descriptions, prices, availability and other information accurate.
Occasional typographical, technical or administrative errors may occur.
We may correct such errors when discovered, subject to applicable consumer law and any binding transaction already concluded.
19. Liability
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
To the maximum extent permitted by law, GrindGALLERY will not be responsible for losses that:
-
Were not reasonably foreseeable when the contract was entered into;
-
Result from circumstances outside our reasonable control and for which we are not legally responsible; or
-
Result from the customer's misuse of the product or failure to follow applicable instructions.
Nothing in this section limits mandatory consumer protections or liability that cannot lawfully be excluded or limited.
20. Fraud and Abuse
We may take reasonable measures to protect GrindGALLERY and its customers against fraud, abuse, chargeback fraud, unauthorised transactions or misuse of our return and delivery processes.
Where reasonably necessary, this may include:
-
Requesting additional information to verify an order.
-
Limiting or cancelling suspicious transactions.
-
Reviewing repeated claims.
-
Providing relevant evidence to payment providers, carriers, insurers or competent authorities.
Any processing of personal information for these purposes will be subject to our Privacy Policy and applicable law.
21. Privacy
Personal information collected through the store is handled in accordance with our Privacy Policy.
22. Changes to These Terms
We may update these Terms from time to time.
Changes will apply from the date the revised Terms are published and will not retrospectively alter completed transactions where doing so would be contrary to applicable law.
The Terms applicable to an order are generally those made available in connection with the transaction at the relevant time.
23. Governing Law
These Terms and transactions with GrindGALLERY are governed by the laws applicable to the operator of GrindGALLERY, subject to any mandatory consumer protection rules that apply based on the customer's country of residence.
Nothing in these Terms deprives a consumer of mandatory protections that cannot be excluded by contractual agreement.
24. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will apply to the maximum extent permitted or, where appropriate, be treated as severed without affecting the remaining provisions.
25. Contact
Questions regarding these Terms or an existing order may be submitted through the Contact Us page available on the GrindGALLERY website.
